It did so by expressing, amongst other things, the view that changing gender is not possible, thus “den(ying) the reality of transgender people.” The Tribunal ordered Whatcott to pay $35,000 for injury to Oger’s dignity, feelings and self‐respect as well as $20,000 in costs. “To cast a transgender person as immoral purely because of their gender identity,” the Tribunal wrote, “is the very essence of discrimination.” The three-member panel found that Whatcott’s flyer exposed Oger and other transgender people to hatred or contempt because it inhibited the ability of transgender people to “find self‐fulfillment” and meaningfully participate in the democratic process. He had discriminated because he expressed the view, based on his religious beliefs, that transgenderism is immoral. In its decision released in late March, the Tribunal found that Whatcott had discriminated against Oger and exposed her to hatred or contempt in violation of section 7 of the Code. After the election, Oger brought a human rights complaint under the B.C.
